## 1. ACCEPTANCE OF TERMS
By requesting services, purchasing parts, scheduling work, signing a work order, or using services provided by Superbike Garage LLC (“Superbike Garage,” “we,” “us,” or “our”), the customer (“Customer,” “you,” or “your”) agrees to be legally bound by these Terms of Service, Liability Waiver, and Service Agreement.
If you do not agree, do not authorize services.

## 2. SERVICES PROVIDED
Superbike Garage provides motorcycle maintenance, repair, diagnostics, aftermarket part installation, inspections, and related services.
All services are performed based on customer authorization. Additional repairs or parts beyond original estimates may require additional approval.

## 3. CUSTOMER RESPONSIBILITY
Customer confirms:
- They are the legal owner or authorized agent of the vehicle
- The motorcycle is provided for lawful service
- They authorize requested repairs/modifications
- They understand aftermarket modifications may alter performance, safety, emissions compliance, manufacturer warranties, or street legality
Customer is solely responsible for maintaining safe operation after service completion.

## 4. PERFORMANCE, AFTERMARKET & RACE-USE DISCLAIMER
Superbike Garage may install aftermarket, or custom parts.
Customer acknowledges:
- Certain parts may not comply with local, state, or federal laws for public road use
- Superbike Garage does not guarantee street legality of customer-selected modifications
- Customer assumes full legal and safety responsibility for operation of modified vehicles
- Performance modifications may increase wear, mechanical stress, or failure risk
Superbike Garage is not liable for damages, injuries, citations, or losses related to modified or performance vehicles.

## 5. NO GUARANTEE OF SPECIFIC RESULTS
While we strive for quality workmanship, Superbike Garage does not guarantee:
- Specific horsepower or performance outcomes
- Manufacturer warranty preservation
- Completion by exact deadlines
- Compatibility of customer-supplied parts
- Prevention of future mechanical failure
Estimated timelines are approximate and subject to supplier delays, hidden damage, labor demands, and circumstances beyond our control.

## 6. CUSTOMER-SUPPLIED PARTS
If Customer provides parts:
- Installation is at Superbike Garage discretion
- No warranty applies to customer-supplied components
- Labor related to defective or incompatible parts is billable
- Superbike Garage is not responsible for failures caused by customer-supplied parts

## 7. PAYMENT TERMS
- Deposits may be required before parts ordering or service scheduling
- Deposits for ordered parts are non-refundable once parts are purchased or work begins
- Full payment is due upon service completion unless otherwise agreed in writing
- Unpaid balances may incur late fees
- Returned payments may incur additional fees
- Customer is responsible for collection costs, attorney fees, and recovery expenses on unpaid invoices where permitted by law

## 8. STORAGE FEES & ABANDONED VEHICLES
Vehicles not picked up within [Insert #] days after completion notice may incur storage fees of $[Insert Amount]/day.
Vehicles abandoned, unpaid, or unclaimed may be subject to mechanic’s lien, sale, or disposal as allowed under applicable state law.

## 9. LIMITED WARRANTY
Unless otherwise stated in writing:
- Labor warranty: [30] days from completion date
- Parts warranty: Limited to manufacturer warranty only
Warranty excludes:
- Racing or track use
- Abuse, neglect, crashes, or misuse
- Improper maintenance
- Customer modifications after service
- Normal wear and tear
- Electrical issues unrelated to serviced components
Warranty decisions remain at Superbike Garage’s reasonable discretion.

## 10. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
Superbike Garage shall not be liable for:
- Indirect damages
- Consequential damages
- Loss of use
- Loss of income
- Towing
- Personal injury beyond legal minimum obligations
- Mechanical failure unrelated to direct negligence
Maximum liability shall not exceed the total amount paid by Customer for the specific service giving rise to the claim.

## 11. ASSUMPTION OF RISK
Customer understands motorcycles and high-performance vehicles involve inherent risks, including injury, death, mechanical failure, and property damage.
Customer voluntarily assumes all risks associated with:
- Repairs
- Testing
- Performance modifications
- Riding after service
- Track or race use

## 12. INDEMNIFICATION
Customer agrees to defend, indemnify, and hold harmless Superbike Garage LLC, its owners, employees, contractors, and affiliates from claims, liabilities, damages, or legal actions arising from:
- Customer misuse
- Illegal operation
- Third-party injuries
- Unauthorized modifications
- Customer negligence

## 13. TEST RIDES & DIAGNOSTICS
Customer authorizes Superbike Garage to operate the motorcycle for testing, diagnostics, transport, or verification purposes as reasonably necessary.

## 14. REFUNDS
Labor already performed is non-refundable.
Special order parts, installed parts, diagnostic fees, deposits, and custom work may be non-refundable unless required by law.

## 15. DISPUTE RESOLUTION
Any disputes arising from services shall be resolved through binding arbitration or legal venue in Clay county, Missouri, unless otherwise required by law.
Customer waives participation in class-action claims where legally enforceable.

## 16. FORCE MAJEURE
Superbike Garage is not responsible for delays caused by events beyond reasonable control, including supplier shortages, shipping issues, natural disasters, equipment failure, or illness.

## 17. SEVERABILITY
If any provision is deemed unenforceable, remaining provisions remain valid.

## 18. ENTIRE AGREEMENT
These Terms represent the full agreement unless modified in writing by Superbike Garage.
